Terms and Conditions
1) Contractual Relationship
1.1. This Agreement sets out the Terms and Conditions of Jiblie Application. It constitutes a legally binding agreement between you and Jiblie Application (referred to as Jiblie, “Application”, “We”) concerning your use of the Application.
1.2. By downloading, installing or otherwise accessing the Application, you agree that you understand our Terms and Conditions and Privacy Policy, and that they apply to you automatically and that your use of the Application shall constitute acceptance of these Terms.
1.3. You acknowledge our right to update these Terms and Conditions at any time without notice, and agree to be bound by any updates to them. If you do not agree with these Terms, you should cease using the Application immediately.
2) Legal Nature Of Agreement
2.1. These Terms and Conditions shall constitute the entire and final agreement between Jiblie Application on one hand, and any person visiting or using the Application or any of its features or advantages on the other hand. They declare that they did not rely on any emphasis whether oral or written for accepting this agreement other than the provisions stated herein.
2.2. This agreement shall a valid contract satisfying the legal conditions and elements and shall be enforceable against all said parties. Its provisions and obligations shall be binding on all of them and neither party may derogate from it or terminate it since it has resulted in its legal effects.
2.3. The description of the services and the subsequent pages of the Application prepared by Jiblie Application shall form an integral part of this agreement.
3) About Us
3.1. Jiblie Application is operated by Fajr Al Saada Trading Company; and is registered in the Ministry of Commerce in the Kingdom of Saudi Arabia.
3.2. Jiblie Application is an intermediary between the services providers and the Customers (services seekers).
3.3. Jiblie Application is a platform only to facilitate connecting users to each other and is not accountable for any action that occur between them, it works to monitor and combat any kind of fraud, or misleading and unacceptable activities.
4) Access To The Application And Use Of The Services
4.1. Access To The Application
4.1.1. The user is responsible for obtaining and maintaining all hardware, software and other equipment needed for access to and use Jiblie Application, and all related expenses.
4.1.2. You agree to comply with any, and all guidelines, notices, rules, operating policies, and instructions regarding the use of the Services and/or access to the Application. We reserve the right to review it at any time, and you are aware of any changes to the foregoing when posted on the Application.
4.2. Granted Licenses
Jiblie Application grants you a limited, non-exclusive, non-sublicensable, irrevocable, non-transferable license to:
4.2.1. Access and use the Application for your personal purposes.
4.2.2. Access and use any content, information and related materials that may be made available through the services, solely for your personal, noncommercial use. Any rights not expressly granted herein are reserved by Fajr Al Saada Trading Company and its licensors.
5) General Rules Relating to Use
5.1. Jiblie Application is made available for your personal use without fees, and the Application is prohibited from being used for any unauthorized, illegal, commercial purpose or any other purpose.
5.2. By using the Application, you agree to comply with all Applicable the Kingdom of Saudi Arabia Laws and these Terms and Conditions.
5.3. You agree not to use the Application:
5.3.1. In any way unlawful outside the scope of the purposes explicitly permitted by Jiblie under the terms and conditions.
5.3.2. In any way, that breaches any applicable local, law, regulation or rules of practice.
5.3.3. In any way, that causes damage to our business, reputation or our trademarks.
5.3.4. In any way to impersonate any person, user, restaurant or store.
5.3.5. In any way to post unwanted emails (spam) or messages that support any illegal activities.
5.3.6. In any unlawful manner or in a manner which encourages any illegal activity including (without limitation) copyright infringement.
5.3.7. To publish, receive, upload, download, use or reuse any materials that does not consonant with our approved content standards.
5.3.8. To publish, transmit or insert of any material containing viruses or other harmful software (Trojans, Worms, Logic Bombs, Time Bombs, Keystroke loggers, Spyware, Adware) or any malicious code, files or other software designed to damage, interfere with or identify the normal operation of the service (or any part thereof), or any other software or computer hardware.
5.3.9. To attempt to gain unauthorized access to the Application or any networks, servers or computer systems connected to the Application.
5.3.10. To Modify, copy, adapt, translate, extract the source code or reverse engineer any part of the Application, make any derivative versions of the Application or re-format or frame any portion of the pages comprising the Application, save to the extent expressly permitted in these Terms and Conditions or by law.
5.3.11. To impersonate any person or entity.
5.3.12. To infringement any trademark, copyright or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual relationships.
5.4. You agree to indemnify Jiblie Application from and against any and all losses, damages, costs and expenses (including legal fees), resulting from your use of the Application and/or any violation of the terms of these Terms and Conditions or our Privacy Policy or Applicable Laws.
6) Account
6.1. In order to start using Jiblie Application you must first register and create an Account. By registration your account, you agree:
6.1.1. You have full legal capacity to enter contracts (including, without limitation that you have attained the applicable legal age for entering contracts).
6.1.2. Choose an appropriate name during the registration process.
6.1.3. Provide accurate and complete information. If you provide us information that is untrue or inaccurate, Jiblie Application may suspend or terminate your Account.
6.1.4. Maintaining the confidentiality of the password and username of your Account and for all activities that occur under your Account.
6.1.5. We will process and use your details submitted during registration, or any information you will further pursuant to our Privacy Policy.
6.1.6. Notify Jiblie Application immediately of any unauthorized use of your Account or any other breach of account security.
6.1.7. Not to use your account for any fraudulent or improper purpose or for any purpose that competes with Jiblie Application.
6.1.8. You may not assign or transfer your rights or delegate your duties under the Account without the prior written consent of Jiblie Application.
6.2. If you wish to change either your user name or password or any other information therein you may do so by logging into your Account and going to “settings”.
7) Legal scope of services
7.1. We at Jiblie Application aim to provide you with all your needs, daily orders and your favorite products (from restaurants, groceries, pharmacies, sweets and ice cream shops, flower shops and etc.) at the best prices and had them delivered straight to your doorstep in time for you.
7.2. Jiblie Application provides order and delivery service through our partners across the Kingdom of Saudi Arabia. Each partner has a delivery area to ensure that his products reach the customer in the best condition.
7.3. Conditions of service seekers (customers):
7.3.1. Comply with all applicable laws, terms and conditions before using the application and services.
7.3.2. Commitment to seriousness upon request, credibility in dealing and not to waste service providers’ time.
7.3.3. Dealing with service providers in accordance with the rules and principles of ethics and respect.
7.3.4. The customer acknowledges that he is an independent contractor with the service providers, and that the Jiblie application is not responsible for completing the request, and does not provide any guarantees or undertakings regarding the orders that are being delivered.
7.3.5. Commitment to share the geographical location on the application when ordering delivery service.
7.3.6. Paying the value of the orders requested by the customer from the delivery representative through the Jiblie application.
7.3.7. Paying the required delivery fees, and in case of non-payment, it will be banned from the application until it is paid.
7.3.8. Take full responsibility for entering and verifying delivery addresses.
7.3.9. The customer has the right to rate the service provider, and agrees not to use the rating feature for the service provider to violate any of their rights or to blackmail them or to write obscene language against them or other unacceptable behavior. If done by any user, the application has the right to delete, modify or keep the content of the material written in the evaluation or take the necessary action against the offending user.
7.4. Terms of service providers
7.4.1. Comply with all applicable laws, terms and conditions or notices sent through the application or updated in the agreement without notification regarding their services with customers.
7.4.2. Dealing with customers according to the rules and principles of ethics and respect.
7.4.3. The service provider is obliged to provide the correct data about the service it provides and to add a detailed explanation of it and images to clarify the features and quality of its service if possible, and provide a valid and effective mobile number to follow up on orders.
7.4.4. Submit the required papers and official documents that prove his identity when requested.
7.4.5. Identifying his identity when contacting and communicating with the customer when the order is executed.
7.4.6. The Service Provider shall pledge that service are provided legal and legitimate and do not violate the laws of the Kingdom of Saudi Arabia, and not to use the service or application to harm, harass, or annoy anyone.
7.4.7. Commitment to seriousness and commitment to implement the customer's request without any default or errors.
7.4.8. Commitment not to commit any unlawful or unlawful acts in the place of carrying out the service (such as sexual acts, drinking alcoholic, abuse or transport any kind of drugs or any other illegal acts).
7.4.9. Commitment to keep products and orders safe and in good condition.
7.4.10. Assume the responsibilities and obligations arising from their implementation of the services through the Jiblie Application and he is responsible in facing customers for any damages that arise to them as a result of any failure or errors that occur as a result of the implementation of the service.
7.4.11. The Delivery Representative acknowledges and agrees not to use this service in violation of the application policy in transporting individuals, as this is a clear violation of the application policy and the Saudi Arabian Transport Authority’s law. This service is only aimed for the delivery of orders, items, groceries and any other legal orders with accordance to the laws of the Kingdom of Saudi Arabia. Jiblie Application reserves the right to take all legal action against anyone who violates this policy or any other policy listed in this Agreement.
7.5. Orders
7.5.1. When a customer submits an order through Jiblie Application and that has been received and accepted by the Partner (service provider), you can choose the appropriate delivery representative for you according to the price or evaluation to complete your order.
7.5.2. In the event that the customer orders the delivery representative to purchase specific products, he must explain the name and specifications of the product, in which case the delivery representative is obligated to issue an invoice for the products he purchased and the total amount required to be paid and to attach the payment receipt in the order to prove this and the customer is obligated to pay the delivery representative the total value of the purchases in addition to Delivery service fees upon receiving his order.
7.5.3. The customer is obliged to provide accurate information and a correct address in the order, and in the event that the customer is not available at the specified address when his order is delivered, the orders are not delivered to any other address. The customer assumes all legal liability for any orders sent to an address that proves he was mistaken in writing it.
7.5.4. An authorized person is required to receive the order at the specified delivery location.
7.5.5. The delivery representative is prohibited from transporting any of the prohibited items in the Kingdom.
7.5.6. The customer's acceptance of the order that was delivered is completely accepted in his condition. The products / orders become his property after paying all the due sums.
7.5.7. The customer and the delivery representative bear all the consequences arising from the performance of the service, and each of them has the right to refer to the other without any responsibility on the application of Jiblie.
7.5.8. Jiblie is reserves the right to refuse to provide any service or use of the application without giving reasons.
7.6. Cancellation
7.6.1. The customer has the right to cancel the order within a reasonable period time before the order becomes a started order through direct contact with the partner (service provider).
7.6.2. For delivery orders that come within special offers that can be delivered within a short time, cancellation or modification can be made during……. Minutes from the confirmation of the request.
7.6.3. The customer cannot cancel specially prepared orders according to specific dietary needs or preferred flavors of your choice of personal choice.
7.6.4. You will not be charged for any orders cancelled in accordance with this clause. If any order you wish to cancel becomes a started order, you will be charged a fee. Jiblie only will determines at its own discretion whether an order is a Started Order or not.

8) Financial Transactions
8.1. Prices
8.1.1. All prices and fees for orders at Jiblie Application are displayed in the country's local currency.
8.1.2. Prices are liable to change at any time, but these changes will not affect orders in respect of which you have been presented with the Confirmation Email, in the case of an obvious pricing mistake, whereby we will notify you as soon as we can about the pricing issue.
8.2. Payment
8.2.1. Jiblie App provides payment by credit card (Visa- MasterCard- Mada), cash or Wallet credit.
8.2.2. We do not store payment information, and you must make sure that the information used in the payment is correct, accurate and valid before you complete the payment process.
8.2.3. Service provider usually checks prices as part of the order completion process.
8.3. Wallet Account
8.3.1. A prepaid system that allows users to purchase orders submitted in the Jiblie Application through the balance on it.
8.3.2. The customer has the right to charge the wallet credit or add refunds from orders that have not been implemented, or that have not been delivered, and use them to purchase other orders.
9) Legal Liability
9.1. You confirm that all information and details provided by you to are true, accurate and up to date.
9.2. You agree to abide by the restrictions on your use of the Application as set out in these terms.
9.3. You expressly agree that your use of the Application is at your sole risk.
9.4. You expressly agree that Jiblie Application is not responsible of any data breach due to hackers attack.
9.5. You agree that Jiblie Application has the right to suspend the service for indefinite periods of time or cancel the service at any time, without notifying you.
9.6. You agree to assume full responsibility for your use of the Application and agree that any information you send or receive during your use of Jiblie Application may not be secure and may be intercepted or otherwise accessed by unauthorized parties.
9.7. You agree to compensate us for any loss or damage caused by non-compliance with these terms and conditions or because you violated these Terms and conditions, and you must bear the costs and expenses of any direct and indirect claims.
10) Disclaimer
10.1. The Application, and the information contained in it, is provided to you “as is” and “as available” without any warranties or representations of any kind, whether express or implied.
10.2. Jiblie is not liable for any losses or damages, (including without limitation, direct, indirect, consequential or incidental losses or damages) in connection with any use of the Application or arising from the App including without limitation:
10.2.1. Any information, materials or recommendations related to the Application.
10.2.2. Any matters beyond Jiblie’s control, including without limitation the incorrectness or incompleteness of input data and information provided on third party websites that may be linked to the Application, directly or indirectly.
10.2.3. Interference with or damage to any other Application on your device.
10.2.4. Use of the Application with any incompatible operating system.
10.2.5. Cessation of the Application from functioning; or disabling of the Application.
10.2.6. Termination of this Agreement.
10.3. Jiblie shall not be liable for damage to your mobile device, software, data or other property as a result of your download, installation, access to or use of the Application or your obtaining any material as a result of using the Application. Jiblie shall also not be liable for the actions of third parties.
10.4. Jiblie makes no representation or warranty that:
10.4.1. Your access to the Application will be uninterrupted, timely or error-free.
10.4.2. The use of the Application or any material or content contained in it complies with the laws of the Kingdom of Saudi Arabia.
10.4.3. The service provider or customer to fulfill their commitments to each other.
10.5. Jiblie shall also not be liable for any links to the third-parties websites that may be accessible from the Application or for any instructions provided therein or the content to such websites.
10.6. Jiblie does not warrant that the Application or servers will be error-free, free from unauthorized access, any e-mail sent from the Application is free of viruses or other harmful components, or that Application will meet your requirements.
10.7. Jiblie shall not be liable for any action, damage or dispute that occurs between users when orders are executed, as only the Customers (services seekers) and providers bear the responsibility of such action.
10.8. Jiblie shall not be liable for the preparation or processing of the goods, products or orders, but rather the responsibility of the applicant. For example, when your order is accepted from a restaurant, this represents an agreement between you as a customer and the restaurant, and the restaurant alone bears responsibility for this order. Cash are paid directly to the restaurant that makes the order. And if you choose to pay by credit cards through the application, Jiblie will be a mediator between you and the restaurant, and delivery fees or any other fees for each order will be charged and based on each restaurant's policy. Any other delivery fees or other fees will be clearly displayed in the order summary.
10.9. Jiblie does not bear any responsibility for any relationship or agreement between the service provider and the Customer with regards to service, contractual, technical, financial or otherwise regarding the fulfillment of mutual commitment (between users).
10.10. Jiblie is reserves the right to delete and cancel any service that does not adhere to the terms and conditions of this agreement.
10.11. Jiblie is reserves the right to legally hold any user accountable for using the application for any legal or lawful violations or for the purpose of defamation or impersonation or use of the application for non-purpose by a competitor, and other irregularities that are not acceptable.
10.12. On the Jiblie Application, we may display names, marks, products, ads, third-parties services, pop-up texts, or third-parties links, If you decide to link to any third-party site, you do so entirely at your own risk.
10.13. We have the right to suspend the service for indefinite periods or cancel the service at any time, without notifying you.
10.14. We endeavors to do its best ability to ensure that the Application is available for use, but we do not be liable for any possible interruptions of the service due to, but not limited to, maintenance work, technical problems or other similar causes, and we do not take responsibility for damages which may be caused by operation failure of the Application.
10.15. You must comply with any applicable third party terms when using the Application (by way of example, you must ensure that your use of the Application is not in violation of your mobile device agreement or any wireless data service agreement).
11) Accuracy of the Information
Information on this Application may contain typographical errors, inaccuracies, or omissions in relation to services, pricing, descriptions, information, and other matters. Jiblie Application reserves the right to correct any errors, inaccuracies, or omissions and to discontinue, change or update information at any time without prior notice.
12) Intellectual Property Rights
All rights, including copyright, database rights, trademarks, and other intellectual property rights in and relating to the Application are the property of Fajr Al Saada Trading Company. You agree not to use any of the materials on the Application for commercial purposes without obtaining a license from us to do so.
13) Trademarks
13.1. Jiblie Application and all page headers, trademarks, service marks and logos appearing on this Application, unless otherwise noted, are trademarks (whether registered or not) owned by Fajr Al Saada Trading Company.
13.2. You are not authorized to display or use the Marks in any manner without the express prior written consent of Jiblie Application.
13.3. The use or misuse of the Marks or other trademarks, names, logos, service marks or any other materials contained herein, except as permitted, is expressly prohibited.
13.4. All names and trademarks mentioned, displayed or otherwise indicated on the Application are the property of their respective owners.
14) Third Party Links
Jiblie Application may contain links to other websites, applications and resources provided by third parties. We do not endorse these links and are not responsible for any content, advertising or other materials available from the external sites or resources linked to the Services. We are not responsible for transactions between you and any third party.
15) Privacy
Jiblie Application will only use your personal information in accordance with our Privacy Policy. By using the Application, you acknowledge and agree that you have read and accepted the Terms & Conditions and Privacy Policy in our Application.
16) SECURITY
16.1. You agree to provide security for Jiblie Application and its affiliates and to protect them from any damage that may catch up with them due to claims, losses, failures, costs and expenses caused by a violation of the User Agreement, or your violation of any related law.
16.2. You must take all reasonable care measures to ensure that your email is safe and not used by anyone else, as your email is used to reset your account password and we may use it to communicate with you regarding your account security.
17) Electronic Communications and notifications
17.1. When you use our Application or send emails to us, you are communicating with us electronically, and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be ‘in writing’.
17.2. Your email address is used to send you information about our services unless you opt-out of such emails using the opt-out link in the emails.
17.3. Jiblie Application may provide notifications to you as required by law or for marketing or other purposes at its discretion to the email address you have provided and/or registered with on our Application, hard copy, or posting of such notice on our Application, or by sending a notification through our Application.
18) Digital Signature
Through your use of Application, registration to get an account via the Application or via clicking for accepting the conditions of the service upon claiming so via the Application, you shall be considered to have implemented this agreement and the other conditions of the service online and it shall be legally enforceable for you from the date of using the Application, registering your account or from the date of clicking for accepting the conditions of the service.
19) Indemnification
You agree to defend and indemnify Jiblie Application, its affiliates from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including attorneys' or legal fees) arising out of or relating to your violation of these Terms and Conditions or your use of or inability to use the Application and any of the Services or the Content.
20) Force Majeure
20.1. Jiblie is not responsible for any failure or delay in performance due to circumstances beyond its control. Jiblie is also not responsible for any incident, resulting in the suspension or disruption of the application automatically.
20.2. Jiblie shall not be in breach of the Contract nor be liable to the Customer for delay in performing, or failure to perform, any of its obligations under the Contract if such delay or failure is attributable to a Force Majeure Event.
21) Termination
21.1. Jiblie Application reserves the right to suspend or restrict your access to the Application, with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if we chooses to do so.
21.2. You can terminate this agreement at any time by uninstalling the Application.
21.3. Unless notified otherwise, upon termination, the rights and/or licenses granted to you in these Terms and Conditions shall cease and you agree to stop using the Application and (if necessary) delete the Application from your device.
22) General Provisions
22.1. These Terms and Conditions (as amended from time to time) constitute the entire agreement between you and Jiblie Application concerning your use of the Application.
22.2. Jiblie Application reserves the right to update these Terms and Conditions from time to time. If we do so, the updated version will be effective immediately. You are responsible for regularly reviewing these Terms and Conditions so that you are aware of any changes to them and you will be bound by the new policy upon your continued use of the Application.
22.3. Jiblie Application reserves the right to make any changes to the Application or services at any time and for any reason.
22.4. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, and subject to the exclusive jurisdiction of the Saudi courts, which shall settle all disputes arising in connection with these Terms and Conditions.
22.5. If any provision in these Terms is held invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
22.6. Failure or delay by us to enforce any of these Terms will not constitute a waiver of our rights against you and does not affect our right to require future performance thereof.
22.7. You may not assign your rights or obligations under these Terms to anyone.
22.8. These terms and conditions is drafted in Both Arabic and English, the Arabic text is applicable before all the official and unofficial bodies if the English language conflicts with it.
22.9. These terms and conditions shall only be canceled by a decision issued by Jiblie Application Administration.
